Whinash Windfarm Inquiry - Statement of MattersWhere the Secretary of State for Trade and Industry causes a Pre-Inquiry Meeting to be held in respect of an application for consent under section 36 of the Electricity Act 1989, she/he is required by rule 5 of the Electricity Generating Stations and Overhead Lines (Inquiries Procedure) Rules 1990 (“the Inquiry Rules”) to serve a statement of the matters which appear to her/him to be likely to be relevant to her/his consideration of the application in question. The Statement of Matters in relation to the Whinash Windfarm section 36 application was issued on 27 October 2004. To view the Statement please click here. There is no similar requirement for the Secretary of State for the Environment, Food and Rural Affairs to produce such a statement but the Statement of Matters issued did include the relevant considerations under section 194 of the Law of Property Act 1925. |
